Capacity Assessments for Guardianship and/or Trusteeship

At Manor Clinic, we provide capacity assessments for individuals who may require legal Guardianship and/or Trusteeship due to concerns about their ability to make personal care or financial decisions. These assessments evaluate an individual’s mental and cognitive functioning to determine whether they can make informed decisions independently.

What is a Capacity Assessment for Guardianship and/or Trusteeship?

A capacity assessment is a formal evaluation to determine whether an individual has the mental capacity to manage their personal care, property, or finances. This assessment is typically conducted when there is concern about a person’s ability to make decisions due to conditions such as dementia, brain injury, or intellectual disability. The results guide courts and legal authorities in deciding if Guardianship and/or Trusteeship is needed to manage the individual’s affairs.

Who Conducts Capacity Assessments?

At Manor Clinic, qualified professionals, including psychiatrists or psychologists, conduct these assessments in accordance with the Adult Guardianship and Trusteeship Act. This ensures that the process is thorough, objective, and in line with legal standards.

Referral Process:

Capacity assessments are generally initiated by family members. Although other professionals, such as family physicians, can initiate the referral, this is not required. Family members can contact the clinic directly to request an assessment.

Post Diagnostic Support:

After a capacity assessment is completed, we provide a signed capacity assessment report for you to submit to the Office of the Public Guardian and Trustee as part of the application process for Guardianship and/or Trusteeship.
